These Terms of Service ("Terms") govern your use of melsmark.art (the "Site"), operated by Melsmark, LLC ("Melsmark," "we," "us," or "our"), a Minnesota limited liability company. By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About Melsmark

Melsmark is a creative design studio offering website design, logo design, graphic design, home renderings, and artistic plat maps for small businesses. The Site provides information about our services and a way to request a quote.

Quotes and Estimates

Information on the Site, including pricing and package details, is provided for general informational purposes and does not constitute a binding offer. Any quote or estimate we provide is an invitation to discuss a project, not a contract. The specific terms of any project, including scope, pricing, timelines, payment, ownership, and revisions, will be set out in a separate written agreement or proposal between you and Melsmark before work begins.

Submitting Information

When you submit the contact or quote form, you agree to provide accurate information and confirm that you have the right to share any details you include. We handle the information you submit in accordance with our Privacy Policy.

Intellectual Property

All content on the Site, including text, graphics, logos, illustrations, images, and design, is owned by Melsmark or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission. The "Melsmark" name and logo are marks of Melsmark, LLC. Ownership of work produced for clients is governed by the separate project agreement for that work.

Acceptable Use

You agree not to use the Site to violate any law, infringe the rights of others, transmit harmful code, attempt to gain unauthorized access to the Site or its systems, or interfere with the Site's normal operation.

The AI Readability Check Tool

The Site offers a free tool at /ai-readability-check that analyzes a website address you submit and reports how readable that site appears to be to AI systems. The following terms apply to it in addition to everything else here.

You must be authorized. By submitting a website address, you represent that you own that website or are otherwise authorized to request an analysis of it. Do not submit sites belonging to other people without permission.

Results are informational and not guaranteed. The tool performs a limited set of automated checks on a small sample of publicly available pages at a single moment in time. Some checks rely on assessment by an AI model, and some rely on answers you provide about your own business, which we cannot verify. Results may be incomplete or wrong, websites change, and the systems being measured change without notice. The tool is provided for general information only. It is not professional advice, and it is not a substitute for a full review of your website.

No guarantee of outcomes. We do not promise that acting on the results will cause your business to be cited, recommended, ranked, or found by ChatGPT, Google, Gemini, Perplexity, or any other system. No one can promise that. Search and AI platforms decide independently what they show, and they do not publish their criteria.

Fair use of the tool. The tool is for occasional use by business owners checking their own sites. You agree not to use it in an automated or bulk fashion, not to attempt to overwhelm or probe our systems or anyone else's through it, and not to use it to analyze sites you have no right to analyze. We apply rate limits and caching, and we may limit, suspend, or refuse service at any time for any reason, including to control costs.

Third-party processing. Running the tool sends short excerpts of public text from the submitted site to Anthropic's Claude API for one of the checks. Our Privacy Policy explains this in detail. If you are not comfortable with that, do not use the tool.

Availability. The tool is free and may be changed, limited, or withdrawn at any time without notice.

The Site may contain links to third-party websites and services that we do not control. We provide these links for convenience and are not responsible for their content, products, or practices.

Disclaimer of Warranties

The Site is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, Melsmark, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred dollars ($100).

Indemnification

You agree to indemnify and hold harmless Melsmark, LLC and its owner from any claims, losses, or expenses arising out of your misuse of the Site or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Minnesota, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and we will revise the "Last updated" date above. Your continued use of the Site after changes are posted means you accept the updated Terms.
